OCI eligibility refers to the criteria under which a foreign national may obtain an Overseas Citizen of India card from the Government of India. Any person who was an Indian citizen on or after 26 January 1950, or who was eligible to become a citizen on that date, qualifies for OCI status. Children and grandchildren of such persons are also eligible, and the spouse of an Indian citizen or an OCI cardholder qualifies provided the marriage has lasted at least two continuous years. OCI cards are valid for the lifetime of the holder and exempt cardholders from registering with the Foreigners Regional Registration Office regardless of the duration of their stay in India. Citizens of Pakistan and Bangladesh are explicitly barred from obtaining an OCI card under the Citizenship Amendment provisions. Once granted, OCI status confers the right to live, work and study in India indefinitely and provides parity with non-resident Indians for most financial and property transactions, but the cardholder cannot vote, stand for elected office or purchase agricultural land.
