Aadhaar card rules for NRIs: KYC & compliance updates

An Aadhaar card is not mandatory for Non-Resident Indians (NRIs), but it remains a valid proof of identity. Once your status changes to non-resident under FEMA, you must notify your bank and update your KYC. Using a resident Aadhaar for resident-only banking is a violation of compliance.

Aadhaar is optional but KYC redesignation is mandatory

While an Aadhaar card is not mandatory for NRIs, you are permitted to hold and update one if you have a valid Indian passport. However, you cannot use your Aadhaar to open or operate resident Indian bank accounts once you reside abroad — you must redesignate those accounts to NRO/NRE using non-resident KYC documents.

UIDAI guidelines on Aadhaar for NRIs

Under the Aadhaar Act, only resident individuals (who have resided in India for 182 days or more in the 12 months preceding the application date) are eligible for Aadhaar.

However, the UIDAI has introduced a special provision for NRIs holding a valid Indian passport. NRIs can apply for an Aadhaar card at any Aadhaar Kendra in India upon arrival, without having to complete the 182-day stay requirement.

If you already had an Aadhaar before moving abroad, your card remains valid. There is no requirement to surrender your Aadhaar card when you become a non-resident. It continues to serve as valid identity and address proof.

Aadhaar linking and tax compliance (PAN-Aadhaar)

In India, linking your PAN card with Aadhaar is mandatory for resident taxpayers to keep the PAN active.

NRIs are exempt from the mandatory PAN-Aadhaar linking requirement under Section 139AA of the Income Tax Act. To claim this exemption, the NRI must ensure their status is updated to 'Non-Resident' in the Income Tax e-filing portal database.

If your PAN becomes inoperative because your NRI status was not updated with the Income Tax department, you will face higher TDS rates (up to 20%) on Indian income, and you will not be able to file tax returns. Link your PAN with your NRO/NRE bank details promptly.

Aadhaar for NRI banking and KYC

Many NRIs ask if they can use their Aadhaar card to open new bank accounts online. While some banks accept Aadhaar as identity proof, they will still require your overseas address proof and passport copy to open an NRE or NRO account.

Opening a normal resident savings account using Aadhaar after you have become an NRI is a direct violation of FEMA regulations. You must declare your NRI status to the bank so they can open an NRO/NRE account.

If you have existing resident savings accounts, you must submit a KYC updation request to convert them to NRO accounts. The bank will record your non-resident status and link it to your Aadhaar/PAN details.

Yes, if they are resident in India for 182 days or more in the preceding 12 months. OCI holders living abroad are generally not eligible for Aadhaar unless they return to India and complete the residency stay requirement.

NRIs can only update their mobile number in Aadhaar by visiting an authorized Aadhaar Kendra in India in person. Online mobile number updates without biometric verification are not permitted for security reasons.
